3. Quotes and Pricing
Pricing is based on service type, scope, timeline, complexity, location, production requirements, research tools, survey distribution, vendor needs, and deliverables. Quotes may expire after the stated validity period. Additional fees may apply for expanded scope, rush work, travel, rescheduling, paid media, research platforms, vendor services, survey distribution, or third-party expenses.
4. Payments
Clients agree to pay invoices according to the payment terms provided. Some projects may require a deposit, milestone payment, or full payment before work begins. Late or failed payments may result in delay, suspension, cancellation, or withholding of deliverables.
5. Client Responsibilities
Clients are responsible for providing accurate information, project requirements, creative direction, approvals, schedules, brand materials, location access, and required permissions. Delays caused by missing information, late approvals, or changes in requirements may affect timelines.
6. Project Timelines
Project timelines are estimates unless expressly guaranteed in writing. Oneironaut Studios INC makes reasonable efforts to meet agreed deadlines but is not responsible for delays caused by client inaction, third-party vendors, weather, location issues, payment delays, technology limitations, platform outages, or events outside our control.
7. Revisions
Revision terms depend on the project scope. Minor revisions may be included if stated in the quote or service agreement. Additional revisions, major changes, or requests outside the original scope may require additional fees.
8. Photography Deliverables
Photography deliverables may include edited digital images, selected image sets, licensed image usage, or other agreed assets. Raw files are not included unless specifically stated in writing. Clients may not resell, transfer, alter, or use delivered photography beyond the agreed usage rights without written permission.
9. Research and Polling Deliverables
Research and polling deliverables may include reports, charts, summaries, findings, audience insights, survey results, polling analysis, and recommendations. Results are based on available data, sample size, methodology, respondent quality, and research limitations. We do not guarantee specific business outcomes, public response, revenue increases, campaign results, or market performance.
10. Intellectual Property
Unless otherwise agreed in writing, Oneironaut Studios INC retains ownership of its original methods, drafts, templates, frameworks, concepts, processes, and internal materials. Clients receive usage rights to final paid deliverables according to the approved scope and payment status.
11. Third-Party Services
Projects may require third-party tools or services, including software platforms, survey providers, advertising platforms, vendors, contractors, travel providers, production resources, cloud storage, or analytics tools. We are not responsible for third-party outages, policy changes, pricing changes, service interruptions, delays, or limitations.
12. Cancellations and Refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy. Clients should review that policy before purchasing services.
13. Prohibited Use
Clients may not use our services for unlawful, deceptive, abusive, fraudulent, misleading, or harmful purposes. We reserve the right to refuse or terminate service if a project violates law, professional standards, platform rules, or internal risk policies.
14. No Guaranteed Results
We provide professional services based on experience, research, creative production, and available information. We do not guarantee specific revenue results, sales outcomes, public opinion outcomes, marketing performance, account approvals, or third-party decisions.
15. Limitation of Liability
To the maximum extent permitted by law, Oneironaut Studios INC is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of our services.
